(1) The ranks of the posts in the civil service will be created as prescribed.
(2) When preparing the organizational structure for establishing a new government office and creating new positions or reviewing or changing the existing organizational structure and positions, the relevant ministry shall add programs, workload, nature of work, and positions based on the reason and rationale and available human resources. And the management survey will have to be sent to the Ministry of General Administration with the consent of the Ministry of Finance.
(2A) Based on the consent received as per sub-section (2), the Ministry of General Administration will evaluate it and submit it to the Government of Nepal, Council of Ministers for approval within thirty days. However, in case of changes in the organization structure and positions, only the organization and management survey of the changed organization structure and positions can be submitted.
(3) Posts created and filled contrary to sub-sections (1), (2) and (2A) shall be automatically cancelled.
